Who Can File and Who Benefits

Washington is specific about who brings the claim. The personal representative of the deceased person’s estate must file the wrongful death action, typically named in the will or, when there is none, appointed by the Clark County Superior Court probate department in Vancouver. How Long Do You Have to File a Wrongful Death Lawsuit in Washington?

Washington’s wrongful death statute of limitations, RCW 4.16.080, gives the personal representative three years from the date of death to file, and that deadline remains in effect as of 2026. If a City of Vancouver, Clark County, or state vehicle or agency was involved, a claim must be presented to the government first, with a 60-day wait under RCW 4.96.020 before filing suit.
