Representan a Ashley Schutz por lesiones extremadamente graves que sufri\u00f3 despu\u00e9s de beber demasiado alcohol y causar un accidente automovil\u00edstico. La demanda es compleja y tiene m\u00faltiples demandados y causas de acci\u00f3n, pero en esta publicaci\u00f3n, me centrar\u00e9 en una parte peque\u00f1a y muy interesante del caso, que involucra parte de la reclamaci\u00f3n de la Sra. Schutz contra La Costita, el bar que le sirvi\u00f3 el alcohol.<\/p>\n<p>Ya puedo escuchar la pregunta<b>\u201cPero fue culpa de Schutz que ella bebiera y condujera; \u00bfc\u00f3mo podr\u00eda demandar al bar por un accidente que fue su propia culpa?\u201d<\/b> \u00a1Contin\u00faa leyendo, intr\u00e9pido lector del blog!\u00a0<!--more--><\/p>\n<p>Esta parte en particular de su demanda alega que el bar le sirvi\u00f3 mucho m\u00e1s alcohol del que deb\u00edan. Su nivel de alcohol en sangre era tres veces el l\u00edmite legal despu\u00e9s del choque. Los bares est\u00e1n obligados a tener meseros que est\u00e9n bien capacitados y que cumplan con las reglas de la OLCC. Una de esas reglas es que no pueden servir a alguien que est\u00e9 \u201cvisiblemente intoxicado\u201d. \u00bfEstaba Schutz visiblemente intoxicada y La Costita le sirvi\u00f3 de todos modos? Nunca lo sabremos, al menos tal como est\u00e1n las cosas ahora, porque el Tribunal de Apelaciones de Oreg\u00f3n ha ratificado una ley, ORS 471.565, que establece que una persona que estaba bebiendo no puede demandar al bar que le sirvi\u00f3 en exceso, sin tener en cuenta los hechos reales de la situaci\u00f3n en particular.<img loading=\"lazy\" decoding=\"async\" class=\"alignright size-medium wp-image-16418\" style=\"border: 2px solid black; margin-top: 10px; margin-bottom: 10px;\" src=\"https:\/\/pdxinjurylaw.com\/wp-content\/uploads\/2013\/05\/Oregon-drunk-driving-lawsuit-300x159.jpg\" alt=\"oregon drunk driving accident lawyer\" width=\"300\" height=\"159\" \/><\/p>\n<p>\u00bfTiene sentido esta ley? Bueno, mucha gente piensa que s\u00ed. Si un bar le vende demasiado alcohol a Jack, quien luego atropella a Alice con su auto, entonces Alice puede demandar al bar por embriagar a Jack, pero Jack no puede demandar al bar. Es una ley de responsabilidad personal. Jack se embriag\u00f3 solo y no deber\u00eda poder transferir esa responsabilidad al bar que le sirvi\u00f3.<\/p>\n<p>Ese es el argumento, de todos modos. Contraargumento: ahora el bar se sale con la suya por incumplir las directrices de la OLCC sobre el servicio excesivo. Y no te equivoques: La Costita sirvi\u00f3 a una mujer de 24 a\u00f1os que estaba bebiendo con su jefe, y le sirvieron lo suficiente para que triplicara el l\u00edmite legal. Dependiendo de su peso corporal y del tiempo transcurrido, probablemente sean de seis a nueve copas, aunque podr\u00edan ser incluso m\u00e1s.<\/p>\n<p>Bas\u00e1ndonos en la decisi\u00f3n de la Corte de Apelaciones, uno de los argumentos que su abogado Randy Pickett expuso fue que la ley que proh\u00edbe a las personas demandar a un bar que les sirvi\u00f3 en exceso viola el Art\u00edculo I, Secci\u00f3n 10 de la Constituci\u00f3n de Oreg\u00f3n. Esta es una secci\u00f3n muy querida de la Constituci\u00f3n de nuestro estado que dice: \u201d. . . todo hombre tendr\u00e1 remedio por el debido proceso legal por la lesi\u00f3n que se le haga en su persona, propiedad o reputaci\u00f3n.\u201d Por lo tanto, el argumento de Pickett es que ORS 471.565 es inconstitucional porque deja a Schutz sin ning\u00fan remedio por una lesi\u00f3n que le caus\u00f3 el restaurante.<\/p>\n<p>Un jurado ya tiene la obligaci\u00f3n de comparar la negligencia de las distintas partes antes de emitir un veredicto; es decir, debe decidir qui\u00e9n es responsable y en qu\u00e9 medida. As\u00ed que si un jurado decidiera que Schutz fue responsable en un 50% (deber\u00eda haber dejado de beber antes o tomado un taxi), pero La Cosita tambi\u00e9n fue responsable en un 50% (deber\u00edan haber dejado de servirle antes o haberle llamado un taxi), entonces La Cosita ser\u00eda responsable de un 50% de los da\u00f1os.<\/p>\n<p>Y lo que es m\u00e1s, si La Cosita tuviera una responsabilidad del 49% o menos, no tendr\u00eda que pagar nada en absoluto, seg\u00fan las leyes de negligencia comparativa de Oreg\u00f3n. As\u00ed que ya existe un mecanismo mediante el cual un jurado compuesto por nuestros pares puede determinar de qui\u00e9n fue la culpa. El ORS 471.565 elimina la posibilidad de que un jurado considere los hechos de esta situaci\u00f3n en particular y tome una decisi\u00f3n informada. Le quita a Schutz el derecho a su d\u00eda en la corte, y espero que la Corte Suprema lo declare inconstitucional.<\/p>\n<p>La Corte de Apelaciones tom\u00f3 en serio este argumento pero decidi\u00f3 en contra bas\u00e1ndose en casos previos de la Corte Suprema de Oreg\u00f3n. No tengo informaci\u00f3n privilegiada sobre este caso, ni he hablado con ninguno de los abogados involucrados, pero mi suposici\u00f3n es que Pickett Dummigan esperaba perder en la Corte de Apelaciones, y que su plan es usar este caso para pedirle a la Corte Suprema que reconsidere la constitucionalidad de ORS 471.565.<\/p>\n<p>Como dije al principio, se necesita un abogado valiente para presentar un caso que pida a la Corte Suprema que declare inconstitucional una ley. Estar\u00e1n invirtiendo a\u00f1os de litigio, y mucho tiempo y dinero, sin ninguna esperanza de recuperar nada si no ganan.
