On May 2, 2010, a 54-year-old Portland man was struck and killed as he walked across a Southeast Portland street,<\/a> according to The Oregonian<\/em>.<\/p>\n

The crash occurred around 9:00 p.m. near the intersection of SE 65th and SE Foster Road. Authorities identified the pedestrian as Jeffrey P. Waldrop, 54, of Southeast Portland, and the driver as Nathan Russell Baxter, 30, of Southwest Portland.<\/p>\n

KGW.com reports that an unidentified witness gave his opinion that Waldrop was walking from one bar to another. The unidentified witness also said Waldrop was wearing dark clothing.<\/p>\n

Baxter remained at the scene and is cooperating with the investigation.<\/p>\n

We would like to send our condolences to Waldrop\u2019s family, and let them know we are thinking of them.<\/p>\n

In a Portland pedestrian accident, the law can be confusing. If a pedestrian is hit in a crosswalk, it is generally considered the driver’s fault. However, just like everything in the law, there are exceptions. If the pedestrian was drunk and wearing dark clothes, and it was dark, the driver can sometimes escape prosecution.
