What happens if they deny my treatments?<\/strong><\/p>\n<p><iframe loading=\"lazy\" src=\"\/\/www.youtube.com\/embed\/BGm9vTDf5vM\" width=\"560\" height=\"315\" frameborder=\"0\" allowfullscreen=\"allowfullscreen\"><\/iframe><\/p>\n<p style=\"text-align: left;\">So if you found this video, it\u2019s probably because you searched for something like a<a href=\"http:\/\/en.wikipedia.org\/wiki\/Independent_medical_examination\" target=\"_blank\" rel=\"nofollow noopener\"> <strong>Portland Independent Medical Examiner<\/strong><\/a> or an IME.<\/p>\n<p style=\"text-align: left;\">I get questions about them all the time. I just got one today, and so I wanted to talk about it for a second. Here\u2019s the situation. You\u2019ve been in a car crash, and you probably don\u2019t have a <a href=\"\/practice-areas\/portland-car-accident-lawyers\/\">Portland car accident attorney<\/a> yet and your insurance, your PIP (Personal Injury Protection), the company that you bought your insurance from, is paying for your medical bills. You\u2019re going to the doctor and you\u2019re getting the treatment that you need, and then all of sudden they say, \u201cOh wait, we want to send you for an IME \u2013 an Oregon Independent Medical Examination.\u201d<\/p>\n<p style=\"text-align: left;\">And the thing that you have to realize is t<strong>here is nothing, absolutely nothing, independent about them. In fact we call them DME, or defense medical exams.<\/strong> And even though it\u2019s your insurance company, they\u2019re not doing you any favors. They are sending you to a doctor for one reason, and that\u2019s because they hope that doctor will tell them, \u2018Oh you\u2019re fine, you don\u2019t need to treat any more for your car crash that you were in, you should be done right now, that\u2019s my medical opinion.\u2019 If that happens then the insurance company, your insurance company, can stop paying for your medical bills.<\/p>\n<p style=\"text-align: left;\">So what are your options? I get calls from a lot of people who say, \u201cDo I have to go?\u201d<\/p>\n<p style=\"text-align: left;\">And the short answer is \u201cYeah \u2013 especially if you don\u2019t have a lawyer.\u201d Because if you don\u2019t go, the insurance company will say you\u2019re being uncooperative and by the terms of your contract with them you have to cooperate, and that\u2019s a basis for just denying your benefits right there.<\/p>\n<p style=\"text-align: left;\">There is recourse. There\u2019s things you can do, including suing your own insurance company to force them to pay your medical bills. <strong>So don\u2019t be fooled by the independent in the Oregon Independent Medical Examination.<\/strong><\/p>\n<p style=\"text-align: left;\">How we deal with this issue is, we have a whole medical department who tracks your treatment from the beginning (so the earlier you come to us the better) and because we\u2019ve got a whole team working on that we\u2019re sometimes able to get the medical exam canceled completely. Or if it happens, we keep your benefits from being denied.<\/p>\n<p style=\"text-align: left;\">That\u2019s how it should be handled; proactively from the beginning, and when you\u2019re looking for a lawyer ask about that. Ask about what kind of staff they have on hand to deal with medical issues as they arise \u2013 not a year later. <strong>If you find a good attorney from the beginning, who knows what they\u2019re doing in these types of cases, you\u2019ve got a much better chance of having this not happen<\/strong>.
